This is another case of the use of racial exclusion covenant clause taking place in Muskegon Heights. An appeal was made to the Michigan Supreme Court during which the Mandelbaum v Mc Donnell case was used to uphold a lower court decision. Porter sued Barrett because Barrett, after constructing a house on the land they had purchased, sold the land to a black man. Porter had included a racially restrictive clause on the land. In the justices opinion he sites the previous case as reason to uphold the exclusionary clause.
