Ferguson v Gies (1890)

Supreme Court of Michigan overturned a jury verdict of the Wayne County Circuit court that had ruled in favor of a restaurant manager (defendant) who refused service to a customer on the basis of his (plaintiff’s) race. The chief justice of the Supreme Court reasoned that following the emancipation of slaves and the creation of the 15th Amendment, colored citizens were due rights equal to whites and therefore, the Dred Scott Case, used to incorrectly determine the case in the Circuit court was fallacious and no longer applicable.
